This Software, including its source code, binaries, documentation, and all associated materials (collectively, the "Software"), is the exclusive proprietary property of Individual Entrepreneur Firsov K.M., trading under the trademark ESFOM (collectively, the "Licensor"). The Software is protected by copyright law, the Law of Ukraine on Copyright and Related Rights, and applicable international treaties. Access to or use of the Software does not constitute a transfer of ownership or the grant of any intellectual property rights beyond those expressly set forth herein.

By installing, copying, or otherwise using the Software, you ("Licensee") agree to be bound by the terms of this License. If you do not agree to these terms, you must not install or use the Software.

Grant of License

Subject to full compliance with this License, Licensor grants Licensee a limited, non-exclusive, non-transferable, revocable license to install and operate the Software solely for Licensee's internal business purposes on hardware owned or controlled by Licensee.

Free Tier

The Software may be used without a license key under the Free Tier. The Free Tier provides access to core functionality at no charge and without a time limit, subject to the following conditions:

• Free Tier usage is restricted to a single installation instance.
• Certain advanced features, integrations, and capabilities are available exclusively under paid license tiers (Pro, Enterprise) and are not accessible under the Free Tier.
• Licensor reserves the right to modify the set of features available under the Free Tier at any time upon reasonable notice.
• Free Tier users are entitled to community-level support only; dedicated or priority support requires a paid license.

Permitted Uses

• Installing and operating the Software for internal purposes within Licensee's organization.
• Adjusting configuration files (drivers/*.json, config/topology.json) as necessary for normal operation and integration within Licensee's environment.
• Creating backup copies of the Software solely for archival purposes.

High-Risk Activities

The Software is NOT fail-safe and is NOT designed or intended for use in hazardous environments requiring fail-safe performance, including but not limited to the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High-Risk Activities"). Licensor specifically disclaims any express or implied warranty of fitness for High-Risk Activities.

Restrictions

Except as expressly permitted herein, Licensee shall not, and shall not permit any third party to:

• Copy, reproduce, distribute, publish, or otherwise transfer the Software or any portion thereof to any third party without prior written consent from Licensor.
• Sublicense, rent, lease, loan, or otherwise commercialize the Software.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law notwithstanding this restriction.
• Modify, adapt, translate, or create derivative works based upon the Software.
• Remove, obscure, or alter any proprietary notices, trademarks, or labels affixed to or contained within the Software.
• Use the Software in any manner that violates applicable law or regulation.

Termination

This License is effective until terminated. Licensor may terminate this License immediately upon written notice if Licensee breaches any provision hereof. Upon termination, Licensee must cease all use of the Software and destroy all copies in its possession or control.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, OR OPERATE WITHOUT INTERRUPTION. LICENSEE ASSUMES ALL RISKS ASSOCIATED WITH THE USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO RISKS OF DATA LOSS, HARDWARE DAMAGE, OR SYSTEM FAILURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR HARDWARE REPLACEMENT COSTS) ARISING OUT OF OR IN CONNECTION WITH THIS LICENSE OR THE USE OF THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS UNDER THIS LICENSE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY LICENSEE TO LICENSOR FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) TEN UNITED STATES DOLLARS ($10.00 USD).

Governing Law and Jurisdiction

This License shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this License shall be brought exclusively in the courts of Kyiv, Ukraine, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

Severability

If any provision of this License is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
